Reaction of the Macedonian Police Union

The Macedonian Police Union strongly condemns the reaction of the MP Apasiev who does not represent his parliamentary function with his vocabulary at all.

Namely, Mr. Apasiev, you were stopped by a UNIFORMED POLICE OFFICER, and not by "Jandar" while exercising his duty.

It is not up to you to comment on how he got a job in the Ministry of Interior and how he was educated as a POLICEMAN, because there are precisely established rules in the Ministry of Interior.

According to the legal regulations, a uniformed police officer controls the traffic and acts preventively and repressively in accordance with the established situation on the ground.

Your behavior as an MP, your vocabulary, and especially the ignorance of your obligations and rights arising from your parliamentary mandate as well as the unfounded invocation of parliamentary immunity reflect your personality.

Speaking of your Immunity that you are referring to, here are some law lessons:

The constitutional immunity does not absolve you from either misdemeanor or criminal liability.

Article 64 of the Constitution of the Republic of North Macedonia to which you refer refers:

MPs enjoy immunity. An MP may not be held criminally liable or detained for expressing an opinion or voting in the Parliament. A Member of Parliament may not be detained without the approval of the Parliament, unless he / she is caught committing a crime for which a prison sentence of at least five years is prescribed. The Parliament may decide to apply immunity to a Member of Parliament even when he / she has not invoked him / her, if it is necessary for performing the function of a Member of Parliament. During the term of office, MPs are not subject to obligation in the armed forces.The Member of Parliament is entitled to compensation determined by law.

You as an MP enjoy material and formal immunity. Material immunity is protection from criminal prosecution for an opinion expressed in the Parliament, ie the Member of Parliament can never be held responsible for a word spoken or for voting in a parliamentary procedure.

Formal immunity protects the MP from detention unless he / she is caught committing a crime punishable by at least 5 years of imprisonment as stated in Article 64 of the Constitution of the Republic of North Macedonia.

The official identification card, Mr. Apasiev, is not a document for release from misdemeanor or criminal responsibility, it is a document for establishing identity and function.

As Macedonian Police Union, we call on all our members in the Ministry of Interior, and all employees of the Ministry of Interior not to succumb to such pressures and to perform their duties in accordance with the positive legal regulations in the Republic of North Macedonia.

We, as Macedonian Police Union, will monitor all attacks on our members and in general on all employees of the Ministry of Interior and will react in a timely and reasoned manner.
