The President of the Federation of Trade Unions of Macedonia, Darko Dimovski is a legitimate Acting President of CCM. This was confirmed by the Administrative Court with a Verdict of 13.9.2017, which dismissed Zivko Mitrevski's lawsuit as unfounded against the Resolution of the Ministry of Labor and Social Policy, no. 08-8191/ 14 of 4.8.2017, by which was required the court to issue a decision for an interim measure against the decision of the Ministry of Labor and Social Policy, i.e. a decision banning Darko Dimovski from representing him as a President of the Federation of Trade Unions of Macedonia.
According to the Administrative Court, the Decision of the MoLSP No. 08-8191/14 of 4.8.2017, the Ministry of Labor and Social Policy did not violate the Law to the detriment of the plaintiff i.e. Zhivko Mitrevski pursuant to Article 37 paragraph 1 of the Law on Administrative Disputes which states that the lawfulness of the contested administrative act is examined by the court within the limits of the request from the lawsuit, but it is not related to the reasons of the lawsuit.
The Administrative Court has reached a Verdict that the lawsuit was unfounded also in the part of the special proposal by which Zhivko Mitrevski requested the Administrative Court to issue a decision for an interim measure that prohibits the person Darko Dimovski from representing the Federation of Trade Unions of Macedonia as a President. The court found that there are no conditions for issuing an interim measure related to Article 15 paragraph 1 in conjunction with Article 14 paragraph 2 of the Law on Administrative Disputes.
With this Verdict, once again was confirmed that Darko Dimovski is legitimately elected for the Acting President of the Federation of Trade Unions of Macedonia at the session of the Council of CCM on November 13, 2016, with the support of the majority of the members of the Council of CCM.
This verdict also ends the manipulations of public and the members of the trade unions affiliated in CCM by the person Zhivko Mitrevski.
